What is a Trademark?

Validity of a Registered Trademark:
1. In many jurisdictions, the registered trademark will be valid for ten years commencing from the date on which the registration is approved.
2. An application for renewal of registration must be made within six months
before the expiration, if the registered trademark is needed for use after it
is expired.

3 Steps of registration of a trademark:
Step 1 Comprehensive Study:
Report that includes the search and analysis of the registration probabilities of a trademark
Step 2 Registration Request:
Filing the trademark application before others submitted the registration’s request.
Step 3 Registration Certificate:
Issuance of the trademark registration certificate and forwarding the documentation to the registrant. A report with the trademark registration details is included.
- Application
Upon receipt of the trademark application, Hong Kong Intellectual Property Department will issue a receipt notifying us the alloted application number.
- Deficiencies Checking
Before beginning to examine your application, examiners will carry out a thorough check of the application form(s) and any attachments.
- Search & Examination
Examiners will conduct a search of the trademarks records to see if the same or similar trademark has already been registered or been applied for by others.
- Publication of Trademark
Once your trademark has been accepted for registration, it is published in the Hong Kong Intellectual Property Journal
- Registration
Once your trademark has been accepted for registration, the Registrar of Trade Marks will enter the details of your trademark into the trademarks register and you will be issued with a certificate of registration.
If there are no deficiencies in the application and no objections to the trademark then the whole application process can take as little as 6 months from receipt of application to registration. If there is an official refusal or objection from a third party, your application will go through to hearing stage which will take longer for the registration and may cause an unsuccessful registration.
- Application
Upon receipt of the trademark application Trademark Office of The State Administration for Industry and Commerce (SAIC) PRC will issue a return receipt notifying us the alloted application number and the filing receipt will issue within two months after the filing.

- Search & Examination
Examiners will conduct a search of the trademarks records to see if the same or similar trademark has already been registered or been applied for by others.
- Publication of Trademark
Once your trademark has been accepted for registration, it is published in the SAIC Journal
- Registration
Once your trademark has been accepted for registration, the Registrar of Trade Marks will enter the details of your trademark into the trademarks register and you will be issued with a certificate of registration.
